DepositPass Terms & Conditions (“Terms”)

Welcome to Pledge Asset Solutions Limited trading as DepositPass (“DepositPass” or “we”). At DepositPass we believe that rental deposits shouldn’t be confusing, which is why our website is designed to improve tenants’ experience and financial wellbeing. Together we want to build a community of users working together to improve rental deposits.

Our terms

  1. These terms
    • These Terms set out the manner on which DepositPass will do business (via DepositPass’ website) with you, a user of the DepositPass service.
    • Please read these Terms carefully before you use our website. These Terms tell you who we are, how we will provide our services to you and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
    • This Terms form a binding agreement between you and DepositPass relating to the provision of our rental deposit services.

    • We are Pledge Asset Solutions Limited, a company in England and Wales. Our company registration number is 13668352 and our registered office is at 26, The Haven, Brighton Road, West Sussex, BN15 8EU, England. We trade as DepositPass and our product is named DepositPass.

    • If we have to contact you, we will do so by writing to you at the email address, postal address or telephone number you have provided to us.

  3. Eligibility
    To use our application, you must be at least 18. Nobody under 18 may use our website or provide any personal data to DepositPass, directly or indirectly. Personal data includes identifiable information such as your name, address, telephone number or email address.
  1. Term
    These Terms & Conditions shall remain in full force and effect while you use our website. You may stop using our service at any time, for any reason. DepositPass may terminate your business relationship with them at any time, without any warning or cause. DepositPass shall not need to give any reason for such termination. These Terms and Conditions will continue to apply even after a relationship is terminated.

  2. Intellectual Property
    • All text, images, marks, logos, data, other content, software and materials used by DepositPass to operate the website are proprietary to us or to third parties. DepositPass reserves all rights, including intellectual property rights.
    • If you believe that DepositPass content infringes any copyright or trademark under English or other national law, please contact us immediately using the details under clause 2.2.

  3. Restrictions on Use
    In addition to all other terms and conditions, you as a user of DepositPass agree that you shall not:
  • Copy, modify, adapt, translate or otherwise create derivative works of DepositPass;
  • Use, redistribute, decompile, reverse engineer, disassemble, translate or otherwise attempt to exploit the source code and/or the intellectual property (outlined in clause 5) associated with DepositPass.
  1. DepositPass’ Rights
    • DepositPass reserves the right, but is not obligated to do any of the following:
      • Record user content;
      • Investigate allegations that user registration information does not conform with the Terms and Conditions; or
      • Remove user registration information that is abusive, illegal or prohibited by the Terms and Conditions
    • We reserve the right to suspend or deactivate your account or your access to certain aspects or all of the DepositPass service or to terminate our agreement with you, at our sole discretion, at any time and without notice or liability to you. Upon any such suspension, deactivation or termination, we may delete or remove your content held by us, and other information related to your account. 

  2. Updates to the Terms
    • As DepositPass continues to develop and improve its services, changes may have to be made to these Terms. DepositPass retains the right to modify these Terms by
      • Posting amended terms on our website; and/or
      • Providing advance notice to you of changes, via email preferably or through our
    • In circumstances where we ask you to review and explicitly agree to or reject a revised version of the Terms, modifications will be effective at the time of your agreement. If you do not agree at that time, you will not be permitted to use DepositPass.
    • In circumstances where we do not ask for explicit agreement to updated Terms, the new version will become effective at the date specified in the Terms. By choosing to continue using our service thereafter, this constitutes your acceptance of the modified terms and conditions. You should discontinue your use of DepositPass if you do not agree to modifications.

  3. Limitation of Liability
    • Whilst we aim to make our service as high quality as possible, we cannot promise it will be perfect all the time.
    • If DepositPass is liable to you or any third party for any loss or damage in any way arising from your use of our services, DepositPass’ liability will at all times be limited to the amount paid, if any, by you to DepositPass for the DepositPass services during the term of the business relationship.

  4. Indemnification
    To the maximum extent permitted by applicable law, you agree to indemnify and hold DepositPass, suppliers and other partners harmless from any claim or demand, including reasonable accounting and legal  fees, made by any third party due to or arising out of:
    • Your use of the website; or
    • Your connection to the website;
  1. How we may use your personal information
    We will only use your personal information as set out in our Privacy Policy.
  1. Governing Law and Disputes
    These Terms and any dispute about or involving DepositPass shall be governed by English law and you can bring legal proceedings in respect of our services only  in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
